Wouldn't you only get “assault with a deadly weapon” charge for speeding over 85mph if you actually hit someone? It seems unlikely that a person would be charged with felony assault for going over 85 mph for a speeding ticket. What about on the state hwy's where the speed limit is 70 mph? I have people pass me (while I'm going 75mph) much much faster on a regular basis – so they are easily going 85mph or more). So all those people could be charged with felony assault?

That's no good. Hitting someone with a car on purpose can be classified as “Assault with a deadly weapon.” It can be as bad as if you shot someone. For those that like to speed, you can get the same thing if you get a ticket over 85 MPH.

Oh, and I only hate blanket statements about pit bulls because it effects what people are thinking when they look for a dog to adopt. There was one recently on the Magnolia blog who was only part pit bull up for adoption and it got a little of that prejudice in the comments.

I saw the PI article and at first I thought maybe that the fight the article mentioned breaking out was AFTER the pedestrian was hit. But by the looks of the photos that are posted here it doesn't look like he was in good enough shape to try to engage in a fight after getting hit. So, yeah, it does sound like the car was used as a weapon in the fight. That really sucks.

Probably not too hard as I've heard of that happening in a lot of situations. When I was hit by a drunk driver many years ago she tried to run away and some bystanders tackled her and held her down until the police arrived. I think when you see something awful like that happen, adrenaline kicks in and folks can move really fast when motivated.
