Beware: man masturbating in public with video rolling...

    I was walking down 6th Avenue between 65th and 67th this morning and saw a man lying on his back masturbating in someone’s driveway. I also noticed that he had a camera on the ledge of the driveway – most likely recording people as they walked by. Thinking about it now, I would have liked to take the memory card from the camera...

    A quick search turned up 13 Level 3 Sex Offenders in that neighborhood. If you didn't call the cops....why not? No cel phone? This is a crime. Since school has just started, I'm sure this guy was boping for an audience; perhaps school kids.

    We have to have a zero-tolterance policy about this kind of behavior.

    I don't think it really matters if he was homeless or the resident at the location. The police need to be notified of this kind of activity whenever it occurs.

    Do not attempt to chase down or beat up an exhibitionist, no matter how tempting the idea may be.

    I once chased a wanker over by Greenlake (pointing and laughing had no effect) and the cops said that it was a good thing I hadn't caught him or given him a heart attack because I would have been in more trouble that he was!

    Weird, I know.

    Best approach is to take his picture and call the cops. Even though he's videoing himself, I'm pretty sure he doesn't want you to have photographic evidence of his crime.

    He was probably filming himself for the Hump 5 film festival put on by The Stranger. A year ago I saw a girl masturbating at the sculpture park with a camera rolling filming her and peoples reactions. Part of the competition is to be in public places doing something raunchy, but I must admit this is a bit over the top.

    The police were not correct in what they told you, not that arresting someone is free from risk.

    Assaulting them is a whole different matter and I would never condone that.

    Citizen Arrest in Washington State
    Under Washington law, a private person can conduct a citizen’s arrest for a
    misdemeanor if the misdemeanor: (1) was committed in the citizen’s presence and
    (2) constituted a breach of the peace. State v. Gonzales, 24 Wn. App. 437, 439,
    604 P.2d 168 (1979); Guijosa v. Wal-Mart Stores, 101 Wn. App. 777, 791, 6 P.3d
    583 (2000).
    A person can also conduct a citizen’s arrest for felonies. See State v.
    Malone, 106 Wn.2d 607, 724 P.2d 364 at FN1 (1986) citing State v. Miller, 103
    Wn.2d 792, 698 P.2d 554 (1985) and State v. Gonzales, 24 Wn. App. 437, 604
    P.2d 168 (1979).

    I don't think that making a porn film would be any kind of defense for what was going on here, if it were in fact what was happening which is doubtful. Even if it was, this would either be the dumbest thing this person has done, or an excuse to let fly with some suppressed exhibitionism. Either way it would still be illegal and the person would wind up a registered sex offender which is a pretty harsh stigma.
    The question remains... Did you call the cops? I think it would be an easy arrest and the evidence would be right there.

    Is there a difference of vulgarity if it is a man or a woman doing the act? Not condoning it but I wonder about these types of situations and double standards. I have been shaking my head since I first read this but am really curious. Would your reaction be different if it was a reasonably attractive female.

    Insightful question, motorrad. Perhaps a female would be viewed as less threatening and dangerous to people walking past and, therefore, less disturbing. In any case, what a narcissistic thing to do, perhaps even ultimately cruel, depending upon the past experiences of the hapless viewer. Call the cops on them all. These are not people upon whose shoulders a civil society is built---quite the opposite. (If it's truly meant to be "performance art", the arrival of the police will add drama to the artwork and may spare others, especially the innocents among us, discomfort and pain.)

    Can you tell us where on the block the man was?

    This is the block we live on. The neighbors are alarmed and would like to know if you remember which house, driveway or side of the street he was on? Anything would be helpful. Thanks again.

    east side. A few houses down from 67th. White house. I think the owners may be out of town. He was in the driveway, with the camera on the cement wall of the driveway.

    Good question. There is a difference, which is that men's sexuality, historically and socially, is, unfortunately but accurately, more strongly associated with physical annd social aggression and repression. This really is not the case with women. Furthermore, men, in general (I think; correct me if I'm wrong) are more welcoming and easily aroused by visual sexual stimuli, and so are more likely to find a lewd public act by a woman arousing or at least interesting rather than offensive or threatening. Finally, there is a case that political and social statements can be made through women choosing to be nude/sexually active in public as performance art, social commentary, what have you, in a way that does not apply equally to men (not that that this is very common of course). So, I'd say that, ethically (though not legally) women have a greater entitlement than men to do whatever they want.

    @aballardgirl-Really a lame comment. You should not have bothered. Comes off as lazy and judgmental and doesn't give any insight. We get some insight but not about my question and I try not to jump to conclusions. So why not think about it and actually give a valid thoughtful opinion. Obvious taunt.

    BaLardAss-Thank you for your thoughtful, considered response. I thought my question would go un-pondered. My experience and interviews seem to show a definite double standard when it comes to innies and outies. (cracked myself up, give me a moment.) Excellent points raised even if aballardgirl wants to deride them. I think they have merit in some respects.

    I think that in the last 50 years, men exposing themselves in public has been in startling circumstances for negative and threatening reasons. I never understood the gratification in the act, but must be some, and shock value. But women exposing themselves is usually not done in a threatening fashion, and not in particularly startling circumstances. Like at Mardi Gras for beads. Or flashing a truck driver on the highway (just happened to a friend of mine and she let him take pictures). Or wearing a short skirt on a windy day and being "surprised" when it blows up. What possesses a woman to flash breasts or other parts? To sit on a high chair and cross their legs exaggeratedly when it is obvious they forgot an article of clothing. If a guy wearing a kilt crossed his legs that way the reaction would be different. So there is a temptation to expose oneself in some people of both sexes, just that the audience reaction is very different.

    Come on aBallardgirl. Whatcha got?

    On the 7th of Sept. we had a man jump our patio fence and start masturbating in front of me while I was on the computer. He tapped on the door to get my attention. I told him to get the Fu#$ off the property and he took off after my partner who was walking the dog. It was 2am and was very frightening and violating. I called the police to report him. He was very much in a meth induced psychosis. My partner came back in after I went looking for him and he said the guy tracked him down and started masturbating in front of him. We got his plate number and called the cops. He decided to stay in his car after we told him to leave. He was then arrested by the cops and we have a no contact order on him. We live near the Locks at a apartment complex. Do you have a description of him?
    We just moved to Ballard to get away from some of the crime we lived around before. With all the issues going on in the last two months we are starting to wonder if we made the right decision.

    That is really outrageous. Had you seen him before and had any previous contact or stalking by him? Is he still being held or out? I am sure you couldn't give plate number but a vehicle description would be helpful.
    Ballard is truly off the rails. What a summer folks.
    My earlier post asked people to ponder this issue in relation to gender in an intellectual, academic way. But given the type of behavior reported here by M and how this situation could have escalated it just doesn't seem to matter now. Thankfully no one was hurt physically and I am sure it will take a while to have it pass psychologically. That this person would seek out your partner adds to the oddity.

    I have no problem giving people his plate and car description. We just moved in and he had been knocking on peoples doors trying to find an apartment that was a known drug for drug use. They have been recently evicted. We were keeping an eye on him as he was obviously at the property for no good reason.
    He drove an older silver Jeep Cherokee with front end damage on the drivers side. Plate number 358-UES After describing him to another tenant they mentioned that he had been here in the past but had never exposed himself to anyone. He was very high on amphetamines and it could of escalated but thankfully he was arrested. The city attorney has contacted us for further questioning as victims before the arrest but they have not returned our calls back to them. So I assume if he has no warrants he is back on the street. We placed a no contact order on the guy and hopefully he will understand he will be arrested again if he show up to the property again.

    I look at this issue in terms of the exposer's expected/desired response to their display. What sort of response is this exposer looking for? Appreciation and approval, or shock and disgust?

    The exposer has control over the kind of audience he chooses, and the context of the exposure.

    Mattatya's wanker went to some lengths to find a non-consenting audience. He chose a female stranger, at night, and trespassed into her yard in order to surprise and threaten her. His intent was pretty clear.

    By way of contrast:

    The Utilikilt boys marched in the Fremont Solstice Parade a few years ago, mooning (in unison!) the crowd of men, women, and children. There was much rejoicing.

    In the Pride Parade, handsome (and possibly less handsome) men stripped and gyrated to wild applause. As did women.

    Women have been known to flash male truckers. Presumably some of these male truckers would have responded differently to a male flashing them.

    It's all about context and intent.
